Terms & Conditions

Terms of Use

1. Liability

  1. The LANE3W mobile applications, web applications, and back-end administrative applications (“LANE3W Suite”) are provided by LANE3W, LLC (“Provider”) on an “as is” basis. In no event shall the Provider be liable for any direct or indirect damages, including but not limited to any loss of data or commercial losses, arising out of the use or inability to use the LANE3W Suite. To put it simply, we do our best to make LANE3W a great cloud application suite to use, but cannot guarantee that it will always be entirely without its quirks, as is the case with any software.

  2. In no event shall the Provider be liable for any claims that arise from use or consumption of any content that is uploaded, onboarded or otherwise transmitted through the LANE3W Suite (“Delivered Content”), which includes, but is not limited to, any claims surrounding the substance or accuracy of the Delivered Content, any representations, whether true or not, made in the Delivered Content, and any acts or omissions by a person that views or consumes the Delivered Content.

  3. In other words, we provide a technology that simply enables our customers to deliver their content to end users. We make no claims about, represent or are otherwise responsible in any way for the nature, substance, use and purpose of such Delivered Content.

  4. LANE3W Suite is not fault-tolerant and is not designed or intended for use in hazardous environments requiring fail-safe performance, including without limitation, in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, weapons systems, direct life- support machines or any other application in which software failure could lead directly to death, personal injury or severe physical or property damage (collectively, “High Risk Activities”). The Provider expressly disclaims any express or implied warranty of fitness for High Risk Activities.

2. User Licenses

  1. You may not redistribute or modify any aspect of LANE3W Suite without permission from Provider. The Provider is the copyright holder and retains all rights over  LANE3W Suite, and no third-party or agency is entitled to sell, modify or repackage  LANE3W Suite without prior consent and written permission from the Provider.

  2. The authorized user licences you purchase for the use of  LANE3W Suite are non-transferable and Provider reserves the right to terminate licences which are abused.

  3. We ask you to respect the terms of the licence and require all authorized users to do the same. Do not share the authentication credentials that you or any authorized user creates when logging in the first time. Please contact us on support@lane3w.com with any licence-related issues you encounter.

3. About the Terms of Use

  1. Upon giving you reasonable notice, these terms and conditions may be altered and amended within reason from time to time to reflect the evolving nature of LANE3W Suite and our business.

  2. By using LANE3W Suite, you agree that you have read, understood, and will comply with these terms and conditions.

  3. Our Product is a product developed and sold by LANE3W, LLC an Illinois, USA based LLC

Terms of Access

These Terms of Access (“Terms”) create a legally binding agreement between you and Lane3W, LLC, located at 2045 W Grand Ave, STE B #585463 Chicago, Illinois, USA 60612 (“LANE3W”), regarding your access and use of Lane3W’s MarketingCMO.ai product (“MARKETINGCMOAI”).

By logging into the MARKETINGCMOAI service, you acknowledge that (1) you are authorized to enter into this Agreement for and on behalf of your company, and are doing so, and (2) you have read and understand and agree that your company or you, if you are acting in an individual capacity (in either case, “Customer”), shall be bound by these Terms and the limited warranty and limitation of liability set out in them.

IF CUSTOMER DOES NOT AGREE WITH THESE TERMS, then do not log in or otherwise attempt to access the MARKETINGCMOAI product. If Customer accesses the MARKETINGCMOAI product, that will confirm that LANE3W and Customer agree as follows, in addition to the terms of other existing agreements between LANE3W and Customer:

The MARKETINGCMOAI product uses artificial intelligence (machine learning) to enhance marketing efficiency. Customer consents to LANE3W’S use of Customer’s electronic data, content and information submitted to the LANE3W platform (“Customer Materials”) to train, test or improve MARKETINGCMOAI.

If MARKETINGCMOAI uses large language models (“LLMs”), Customer Materials processed with LLMs shall be limited to Customer-specific LLM training, for the sole benefit of Customer.

Customer agrees that it shall not acquire any ownership rights in MARKETINGCMOAI, the LANE3W platform or LANE3W’s data and technology, even if LANE3W uses of Customer Materials to train, test or improve MARKETINGCMOAI.

Customer understands and acknowledges that, despite LANE3W’s diligent efforts to ensure that MARKETINGCMOAI provides accurate guidance and results, any artificial intelligence system is susceptible to mistakes and misinterpretation of the data it processes and to which it has access. Customer is solely responsible for verifying the accuracy of and interpreting MARKETINGCMOAI’s suggestions and guidance, for making any marketing or business decisions based on information provided by MARKETINGCMOAI, and for making or suggesting any action, spend, messing or other marketing or business decision on the basis of information provided by MARKETINGCMOAI.

 

LANE3W IS NOT A MARKETING AGENCY OR OTHERWISE A CONSULTING SERVICES PROVIDER, AND LANE3W MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, TO CUSTOMER OR OTHER USERS OF THE MARKETINGCMOAI SERVICE REGARDING THE COMPLETENESS OR ACCURACY OF INFORMATION PROVIDED BY LANE3W OR MARKETINGCMOAI, NOR ANY INTERPRETATION, MARKETING DECISION OR BUSINESS ADVICE RELATED THERETO.
